Terms of Service

1. Acceptance of These Terms
These Terms of Service form a binding agreement between you and BillSurgeon LLC, a Wyoming limited liability company (BillSurgeon, we, us, our), governing your use of billsurgeon.com and the audit service (the Service). By uploading a bill, paying, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who May Use the Service
You must be at least 18 and able to form a binding contract. The Service covers medical bills from U.S. providers. You must be the patient named on the bill, or have legal authority to act for them (parent or guardian of a minor, power of attorney, or estate representative). Do not audit or dispute a bill you are not authorized to handle.
3. What the Service Does
BillSurgeon uses an AI assisted process, checked against public CMS and FDA reference data, to review an itemized bill you upload and flag potential billing errors: duplicate charges, incorrect coding, network status mistakes, and similar issues. Where applicable, it can generate a dispute letter for you to review, edit, and send yourself. A free preliminary verdict is shown before payment; full findings and the letter unlock after payment. The Service is a document analysis and drafting tool. It is not a law firm, not a debt collector, and does not act as your representative in any negotiation or proceeding. We never submit anything to your provider, insurer, or a government agency on your behalf.
4. Not Medical, Legal, or Financial Advice
Nothing here is medical, legal, financial, or tax advice, and using the Service creates no attorney client, physician patient, or fiduciary relationship. Findings are estimates for you to investigate, not a determination that a charge is unlawful, and not a guarantee of any refund or recovery. Before disputing a bill or starting a formal process such as the federal No Surprises Act dispute process, verify the findings yourself and, for significant amounts, consider a licensed attorney, patient advocate, or billing professional.
5. No Accounts, Your Responsibility for Accuracy
The Service does not use accounts. Because there is no account to correct later, you are responsible for uploading legible, accurate, complete documents and entering accurate insurance and state information. We are not responsible for errors that come from bad input.
6. Fees, Payment, and Episode Based Pricing
Current pricing is posted on the site and may change for future purchases. As of the Effective Date: $24 for a single insured audit, $15 for a single uninsured or self-pay audit, $72 for a four audit bundle ($18 per audit). We price by medical episode, not by bill: one flat fee covers every bill from one connected episode of care, even across separate providers. If uploaded bills look like they span more than one unrelated episode, we will ask you to confirm; we may decline to process, or require separate payment for, bills that are not part of the same episode. Payments are processed by Stripe; we never receive your full card number. Refunds follow our Refund Policy.
7. Ownership of Your Content and Your Report
You keep all rights to the bills you upload. You grant us a limited license to process them to generate your audit and letter. Once you pay, we grant you a personal license to download, edit, and use your report and letter, including sending the letter yourself. You may not resell or reuse them as a commercial service for others.
8. Our Intellectual Property
The Service, including its software, prompts, reference data methodology, findings taxonomy, design, and the BillSurgeon name, belongs to us or our licensors. Nothing here gives you rights to it beyond the license in Section 7.
9. Things You May Not Do
- Upload a bill you are not authorized to submit
- Use bots or scrapers outside the normal web interface
- Reverse engineer our prompts, models, or reference data logic
- Resell or white label the Service or its output
- Upload malicious files or interfere with the Service
- Use the Service for anything unlawful, including fraudulent disputes
10. Third Party Services
Running the Service means sharing limited data with Stripe (payments), Anthropic (AI analysis, zero data retention), Supabase (infrastructure), Inngest (background jobs), and Cloudflare (hosting). See our Privacy Policy for detail. We are not responsible for these providers' independent actions except where the law requires otherwise.
11. No Warranty
THE SERVICE, INCLUDING ALL FINDINGS, REPORTS, AND LETTERS, IS PROVIDED AS IS AND AS AVAILABLE, WITH NO WARRANTY OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL FIND EVERY ERROR, THAT A FLAGGED ITEM IS ACTUALLY AN ERROR, OR THAT DISPUTING A CHARGE WILL RESULT IN ANY REFUND OR CREDIT. SOME STATES DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT ALL APPLY TO YOU.
12. Limits on Our Liability
TO THE MAXIMUM EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE PRIOR TWELVE MONTHS, OR FIFTY DOLLARS. SOME STATES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.
13. You Agree to Cover Us
You agree to cover our reasonable costs and attorney fees if a claim arises from your breach of these Terms, misuse of the Service, or submitting a bill you were not authorized to submit.
14. Resolving Disputes: Arbitration
Read this section carefully, it affects your legal rights.
First, contact us at legal@billsurgeon.com and try to resolve the issue informally for at least 30 days.
If that does not work, you and BillSurgeon agree to binding, individual arbitration through the American Arbitration Association's Consumer Arbitration Rules, instead of court, except either side can use small claims court.
Arbitration and any proceeding will be individual only, never a class, collective, or representative action.
You can opt out of arbitration by emailing legal@billsurgeon.com within 30 days of first accepting these Terms, with your name and a statement that you opt out.
This section does not limit either party's right to seek an injunction for IP infringement or unauthorized access.
15. Governing Law
These Terms are governed by Wyoming law, except where Section 14 requires arbitration. Any claim not going to arbitration will be heard in Wyoming state or federal court, and you agree to jurisdiction there.
16. Changes to These Terms
We may update these Terms. Material changes update the Effective Date above and, where the law requires, come with extra notice. Using the Service after a change means you accept it.
17. Ending Access
We may suspend or end your access at any time, including for violating these Terms. Since there are no accounts, this generally means we decline to process further submissions from you.
18. Other Terms
If any part of these Terms is unenforceable, the rest still applies. These Terms, the Privacy Policy, and the Refund Policy are the whole agreement between you and us about the Service. You cannot transfer these Terms; we can, as part of a merger, acquisition, or sale.
